Insolvency
Many companies are facing financial pressures today and therefore it is essential that specialist advice is sought and that all possible options are assessed at an early stage. This can often stave off a financial crisis.
Healy O’Connor Solicitors LLP have a number of years of experience of working alongside companies under financial pressures who may be dealing with the possibility of insolvency, and we consistently act in a quick and timely manner in dealing with all issues of insolvency.
We provide legal advice to liquidators, receivers and examiners appointed to Irish companies, and we regularly advise both secured and unsecured creditors in relation to protecting their interests when faced with the insolvency of a customer or business partner.
In addition, we work closely with clients to achieve a solvent restructuring, where possible in order to avoid the need to go through a formal insolvency process. This will involve negotiations with principal creditors and we are skilled at leading such negotiations and implementing restructuring plans.
In situations where there is no other solution than to cease trading, we provide advice on the appropriate insolvency process – typically an administration where the underlying business is viable on a going concern basis.
In addition we also provide advice to Directors who may be faced with restriction or disqualification applications or directors who may be the subject of legal action by insolvency practitioners or the Office of the Director of Corporate Enforcement.
