Birth-Related Injury Negligence Claims

Birth-Related Injury compensation claims arise from complications during delivery or because of negligence on the part of doctors, nurses or hospitals during the delivery process. A negligent delivery can increase the risk that a child will be born with cerebral palsy which occurs because of brain damage which affects the newborn’s ability to properly use its muscles.

Although there are many different types of birth defects and injuries that can occur during childbirth, the more serious of these include:

  • Cerebral Palsy
  • Spastic Quadriplegia
  • Erb’s Palsy
  • Klumpke’s Palsy
  • Facial Paralysis
  • Cephalohematoma
  • Persistent Pulmonary Hypertension
  • Hyploxia / Anoxia
  • Prenatal Asphyxia

Under Irish Law, health care providers owe a duty of care to their patients to provide adequate medical care throughout all stages of childbirth. If you think that you have had a badly handled labour and delivery, or if your baby wasn’t properly cared for after birth, then your child deserves to be compensated.
