€11.5m Awarded for Minor Requiring Lifetime Care

Cullen Kennedy, a minor who suffered catastrophic injuries in a car accident in 2008 leaving him permanently in a wheelchair has been awarded the sum of €11.5 million euros by the High Court.

A settlement was reached before the case went to a full hearing. This award is the biggest in a personal injuries action to date in Ireland. Cullen who is now quadriplegic will require 24 hour care for the rest of his life. He is cared for by his mother and grandmother who are supported by nurses, carers and special needs assistants. The injuries suffered were as a result of a head on collision when the car his mother was driving veered across the road and hit another car head on. Cullens mother was momentarily distracted by him on the way to school.

The issue of the correct calculation of damages was raised in this case as there is currently no legislation  in Ireland dealing with the lifelong care needs of those suffering from catastrophic injuries. We are currently dealing with a number of similar type cases and would hope that the correct legislation is enacted as soon as possible to deal with this very serious issue.
